Notice to police chief over warrants
BANGALORE: The high court on Wednesday ordered issuance of notice to the Bangalore police commissioner on a petition filed by a Mangalore resident. The petitioner has claimed that non-bailable warrants issued by the court 10 times since November 2009 weren’t executed even once.
Athmaranjan Rai, a resident of Bantwal, has claimed that despite the high court upholding the power of consumer fora to issue warrants in terms of criminal procedure code, warrants issued in his case against Vyalikaval House Building Cooperative Society and its president haven’t been executed. The petitioner, who sought refund of his money paid towards site allotment in the layout to be formed by the society, had approached the consumer forum. Like him, many others also approached the forum.
In his case, the forum issued warrants against the society between 2005 and 2006. The forum’s power to issue such warrants was challenged before the high court and was ultimately upheld. Again, the forum issued NBWs ten times against the society and its president, none of which has been implemented till date.
